These Terms govern your use of the Wood Brothers website. Construction work is governed separately by a signed written contract.

1. Acceptance of Terms
By accessing or using hirewoodbrothers.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, please do not use the Site.
2. Scope of These Terms
These Terms govern your use of the website only. They do not govern any construction, remodeling, or repair work performed by Wood Brothers.
All construction work — including custom deck building, pergolas, patio covers, basement finishing, custom sheds, home remodeling, and stairs and railings — is governed by a separate written contract signed by both parties. If anything in these Terms conflicts with a signed construction contract, the signed contract controls.
3. Estimates and Quotes
Any quote, price range, or design summary requested or generated through the Site is preliminary and non-binding. Final pricing requires an on-site inspection and a signed written agreement.
Pricing may change based on, among other things:
- Actual site conditions, grade, access, and drainage
- Material availability and market cost changes
- Permit requirements and inspection outcomes
- Conditions discovered during work, such as rot, water damage, code violations, or structural issues
4. No Guarantee of Availability
Submitting a form, requesting a quote, or contacting us through the Site does not create a contract and does not obligate Wood Brothers to perform any work. Scheduling and capacity are confirmed only through a signed written agreement.
5. Licensing and Permits
Wood Brothers pulls the permits required for the work it performs, in accordance with West Valley City and applicable Utah jurisdiction requirements.
The homeowner is responsible for disclosing HOA requirements and approvals, recorded easements, utility locations known to them, and accurate property line information. Delays or added costs caused by undisclosed restrictions or inaccurate property lines are the homeowner's responsibility.
6. User Submissions
If you upload photos, drawings, measurements, or project details through the Site, you grant Wood Brothers a non-exclusive license to use those materials for the purpose of reviewing your project and preparing an estimate. You confirm that you have the right to share the materials you submit and that doing so does not violate anyone else's rights.
7. Intellectual Property
All content on the Site — including text, layout, design tools, project photography, and the Wood Brothers name and logo — is owned by Wood Brothers and protected by applicable law. Project photos may not be copied, reproduced, or republished without written permission.
8. Third-Party Links
The Site may link to third-party websites. Wood Brothers does not control and is not responsible for the content, accuracy, or practices of those sites.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that any information on it is complete or current.
This disclaimer applies to the website only. It does not limit, reduce, or waive any workmanship or materials warranty contained in a signed construction contract with Wood Brothers.
10. Limitation of Liability
To the maximum extent permitted by Utah law, Wood Brothers is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of, or inability to use, the Site.
This limitation applies to website use only and does not affect Wood Brothers' obligations under any signed construction contract.
11. Indemnification
You agree to indemnify, defend, and hold harmless Wood Brothers and its owners, employees, and subcontractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, or your violation of these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict of law rules. Venue for any dispute lies in the state or federal courts located in Salt Lake County, Utah.
Before starting any legal action, both parties agree to first attempt to resolve the dispute in good faith by contacting the other party in writing and allowing at least thirty (30) days for a good-faith negotiation.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted with a revised date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
